1、No renewing contract at the expiration of hiring period and stop renewing contract with migrant workers.
A migrant worker, who’s contract is about to expire, decides not to continue his/her contract with the original employer under discussion after the expiration date. If the migrant worker wants to continue to work in Taiwan, the original employer can prepare application documents to the Ministry of Labor through Direct Hiring Service Center for【61 Employer-Migrant worker Agreement Expiry Transfer-out without Renewal of Employment】with in 4 months and at the latest no less than 2 months before the expiration of the migrant workers’ employment term. 2、Terminate migrant worker’s employment term
When the employer or the person being cared of dies, the employer closes the factory, the company goes out of the business, or employer does not pay the migrant worker according to the contract, the person who terminates the contract or the person who are not attributable to hire the migrant worker can prepare the application documents to the Ministry of Labor through Direct Hiring Service Center for 【61 Migrant Worker Transfer Out】to terminate labor-employer relationship. If the application is approved, the official documents will be mailed out. Please reach at (02) 8995-6000 if the official document is not received or if you have any further questions. After obtaining the transfer- out permit letter, the employer or the migrant worker should go to public employment service center to handle the migrant worker transferring to another employers or finding a job within 14 days after official documents is received. The employer may obtain the process of abording for migrant workers within the time limits under agreement with the migrant workers.

The employer should register to a public employment service center, and the public employment service center will log the employer and migrant worker’s information into【Employer zone for migrant workers transfer】https://dhsc.wda.gov.tw/
, providing information for other employers and migrant workers.

3、Migrant workers fail to find a new employer during the transfer period
When the migrant worker has not found a new employer during the transfer period, but the migrant worker has special circumstances and has been approved by the central authority to extend the transfer period for another 60 days and this is only one-time limit. The migrant worker who is qualified the previous circumstances, he/she should prepare application documents within 14 days before the expiration of the original transfer period and apply to Ministry of Labor through direct hiring service center for 【66 Extension of transfer for migrant workers（Applying for transferring out without continuing working cannot be extended by law）】If the application is approved, the official documents will be mailed out.
