📢落實移工防疫管理,雇主及私立就業服務機構不得以切結書形式免除防疫管理責任。


‼針對近期科技大廠移工感染事件,部分雇主及私立就業服務機構以切結書形式,約定移工染疫後自負法律責任及治療期間一切所需費用,試圖免除就業服務法管理責任,
勞動部表示切結書無法律效果,雇主仍應依法擔負雇主管理責任,加強防疫措施,避免疫情擴大。

📢 Encouraging foreign workers to sign a declaration in no way reduces the responsibility of employers and private employment services agencies for foreign worker pandemic prevention management

In the wake of several recent cluster infections at major technology plants and in an attempt to reduce their management responsibility under the Employment Service Act, a number of employers and private employment services agencies have asked foreign workers to sign a declaration that stipulates in the event of contracting COVID-19 individual workers take full legal responsibility and will cover all related treatment costs.

The Ministry of Labor hereby clarifies that such declarations have no legal force and employers remain legally responsible for managing the foreign workers they employ, improving pandemic prevention measures and working to prevent the spread of COVID-19.

📢เพื่อให้การบริหารจัดการป้องกันโรคในกลุ่มแรงงานต่างชาติบรรลุผล นายจ้างและ บจง. จะปัดความรับผิดชอบให้แรงงานต่างชาติลงนามในหนังสือรับรองไม่ได้
กรณีที่เกิดการระบาดโควิด-19 ในคลัสเตอร์โรงงานอิเล็กทรอนิกส์ มีนายจ้างและบริษัทจัดหางานบางราย ให้แรงงานต่างชาติของตนลงนามในหนังสือรับรอง โดยผลักภาระความรับผิดชอบให้แรงงานต่างชาติ หากติดเชื้อต้องรับผิดชอบค่าบำบัดรักษา รวมทั้งรับผิดชอบด้านกฎหมายด้วย กระทรวงแรงงานกล่าวว่า หนังสือรับรองดังกล่าวไม่มีผลทางกฎหมาย นายจ้างยังคงต้องรับผิดด้านการบริหารแรงงานต่างชาติตามกฎหมาย เพิ่มมาตรการป้องกันโรค มิให้ขยายวงกว้างออกไป

📢 Penerapan Manajemen Pencegahan Epidemi Pekerja Migran-Majikan dan Penyedia Jasa Tenaga Kerja Tidak Diperkenankan Meminta Pekerja Migran Menandatangani Surat Persetujuan

Terkait terjadinya infeksi penularan komunitas Pekerja Migran di salah satu pabrik teknologi baru-baru ini,n dan penyedia jasa tenaga kerja membuat surat persetujuan apabila Pekerja Migran dikonfirmasi positif tertular COVID-19 maka Pekerja Migran bersangkutan akan memikul tanggung jawab hukum dan seluruh biaya medis yang diperlukan.

Aksi tersebut dinilai seakan-akan hendak melepaskan tanggung jawab manajemen pengelolaan yang tertera dalam Undang-Undang Layanan Ketenagakerjaan.
Kementerian Ketenagakerjaan (MOL) mengatakan, surat persetujuan tersebut tidak memiliki dasar hukum. Sesuai UU yang berlaku, majikan tetap menjadi pihak yang memikul tanggung jawab manajemen pengelolaan dan memperkuat langkah-langkah pencegahan epidemi, guna menghindari meluasnya rantai penularan.

📢 Thực hiện tốt công tác quản lý lao động di trú phòng chống dịch bệnh, chủ thuê và công ty dịch vụ việc làm tư nhân không được dùng bản cam kết để miễn trừ trách nhiệm quản lý phòng chống dịch bệnh

(lightbulb) Để ứng phó vụ việc lao động di trú bị lây nhiễm bệnh tại công xưởng điện tử trong thời gian gần đây, một số chủ thuê và công ty dịch vụ việc làm tư nhân đã dùng bản cam kết, giao ước lao động di trú sau khi bị lây nhiễm bệnh phải chịu trách nhiệm pháp luật và chi trả tất cả các chi phí trong thời gian điều trị, nhằm lẫn tránh trách nhiệm quản lý theo luật dịch vụ việc làm.

Bộ Lao động cho biết, bản cam kết không có hiệu lực pháp luật, chủ thuê vẫn phải chịu trách nhiệm quản lý lao động theo quy định của pháp luật, tăng cường biện pháp phòng chống dịch bệnh, ngăn ngừa dịch bệnh lan rộng.
